Deputy Pepper-Sprays Little Dog; Caught On Camera!

FRESNO COUNTY, Calif. (KMPH) -

Did a Fresno County sheriff's deputy overstep his power when he maced a dog in a fenced in yard?

Take a look and you decide.

In this video provided exclusively to KMPH News, you can see a Fresno County sheriff's deputy park in the middle of the street, and attempt to serve some court papers at a home in Malaga.

Next–door neighbor Jarret Solano came over because he heard his dogs barking.

After telling the deputy his neighbor wasn't home, Jarret thought that was the end of it. But then he saw the deputy pull out his Taser and try to scare his dog, named Teddy Bear, and then the deputy walked over and maced his dog.

Jarret Solano says, "I said hey what are you doing to my dog? And by that time I got over here he already was shaking his hand and going at my dog with the mace."

Jennifer Esteb-Solano says, "I think he was just embarrassed because he got caught, because he didn't know that was our yard as well. I think he thinks he could have gotten away with it."

Sheriff Margaret Mims is out of town, but the sergeants in charge that day wanted to see the video.

So Erik Rosales played it for them at the KMPH studios.

The deputies couldn't comment, but did tell Erik they're looking into what happened, and may send the case to internal affairs.

The Solanos say all they want is an apology.
