On Monday jurors found former Fresno State defensive tackle, Jason Shirley "guilty" on all three counts against him.
"I'm sure he's disappointed that the jury rejected his truth and also the truth of his witnesses," said Shirley's Defense Attorney, Charles Magill.
Police say Shirley, who is now signed with the Cincinnati Bengals, was drunk on October 8, 2007 when he backed a car into a Fresno apartment then drove home.
"I think the jury did a good job evaluating the evidence. I think the evidence was there. There was sufficient evidence to convict and they were able to find the same," said Deputy D.A. Billy Terrence.
This is Shirley's second trial, the first ended in June when jurors failed to reach a verdict after three days of deliberation.
This time jurors came to their decision after just a few hours but Shirley's attorney says it's still not over.
"File an appeal within thirty days, you have a hearing within about three to four months of that," said Magill.
Magill says he believes the Breathalyzer test Shirley was given was flawed and he plans to appeal the decision right away.
Meanwhile, Shirley now faces three years of informal probation, 30 days in the adult offender program, and a fine of $1,674.
