The pumps sending water from the Sacramento Delta south to valley reservoirs are still pumping, but for how much longer?
Attorney's for the federal "defendants" served notice in a Fresno courtroom Tuesday of their intention to use an opinion protecting Delta Smelt to turn those pumps off.
Fresno-based, U.S. District Judge Oliver W. Wanger issued a temporary restraining order last Friday allowing delta pumps to operate at maximum capacity for an additional 14 days.
Wanger ruled that a plan to protect salmon was put into place without a required study into the impact that plan would have on people.
Wanger is now expected to rule on this latest motion concerning the smelt as early as Wednesday.
